Mandatory Reporters of Child Abuse and Neglect

Nevada Rev. Stat. § 432B.220 sets forth a list of professionals required to report suspected child abuse and neglect (including sexual abuse) to authorities. The list includes medical and mental health care providers, coroners, school administrators and teachers, day care and camp workers, members of the clergy and other religious officials, persons licensed to conduct foster homes, law enforcement officers, attorneys, and adults who are employed by entities that provide organized activities for children (such as sports).

In addition, any other person may report suspected abuse or neglect.

Reports must be made within 24 hours. Failure to report is a misdemeanor.

Sexual Abuse and Exploitation

Nevada Rev. Stat. §§ 432B.100; 432B.110 provide that ‘sexual abuse’ includes acts upon a child constituting:

  • Incest
  • Lewdness with a child
  • Sadomasochistic abuse
  • Sexual assault
  • Statutory sexual seduction
  • Mutilation of the genitalia of a female child; aiding, abetting, encouraging, or participating in the mutilation of the genitalia of a female child; or removal of a female child from this State for the purpose of mutilating the genitalia of the child

‘Sexual exploitation’ includes forcing, allowing, or encouraging a child:

  • To solicit for or engage in prostitution
  • To view a pornographic film or literature
  • To engage in filming, photographing, recording on videotape, posing, modeling, depiction, or a live performance before an audience that involves the exhibition of a child’s genitals or any sexual conduct with a child
